These Terms of Service (“Terms”) govern your access to and use of ashwood.gg, its associated pages, online store, content, tools, forms, and other services operated by Ashwood United Group, LLC, doing business as Ashwood United (“Ashwood United,” “we,” “our,” or “us”) (collectively, the “Services”).

By accessing or using the Services, creating an account, submitting a form, or purchasing a product, you acknowledge that you have read and understood these Terms and agree to be bound by them.

If you do not agree to these Terms, do not access or use the Services.

These Terms incorporate by reference our:

  • Privacy Policy
  • Returns & FAQ Policy
  • Shipping information
  • Any product-specific terms displayed before purchase
  • Any additional policies or rules expressly identified as applying to a particular service, form, event, promotion, or opportunity

1. About Ashwood United

Ashwood United is a competitive trading-card organization operated by Ashwood United Group, LLC, a Washington limited liability company.

The Services may include:

  • Competitive-team and player information
  • Tournament schedules, records, and event coverage
  • News, articles, videos, and educational content
  • Merchandise and digital products
  • Calculators, estimators, and other informational tools
  • Partnership and business-inquiry forms
  • Employment, contractor, player, and competitive-opportunity listings
  • Social-media, video, calendar, and third-party embeds
  • Links to third-party websites and services

The availability and scope of these features may change.

2. Fourthwall’s Role

The Ashwood United store is hosted and supported through Fourthwall.

For transactions completed through the Fourthwall-powered store:

  • Fourthwall acts as the Merchant of Record.
  • Fourthwall processes customer payments.
  • Fourthwall collects and remits applicable sales tax and value-added tax where required.
  • Fourthwall assists with chargeback processing.
  • Fourthwall fulfills products supplied through its product catalog.
  • Fourthwall provides customer support for Fourthwall-fulfilled catalog products.

Ashwood United remains the customer-facing seller and brand and establishes the store policies governing the customer relationship, subject to Fourthwall’s applicable platform rules and mandatory law.

Fourthwall is an independent service provider. Its services are also governed by its own terms, policies, and procedures.

3. Eligibility

You must be at least 13 years old to browse or use the general website.

You must be at least the age of legal majority in your jurisdiction to:

  • Enter into a binding purchase
  • Submit a commercial proposal
  • Apply independently for employment or contract work
  • Accept legally binding terms
  • Enter another transaction requiring legal capacity

A minor may use the Services or make a purchase only with the involvement and authorization of a parent or legal guardian where permitted by law.

If you use the Services on behalf of a business, organization, team, publication, or other entity, you represent that you are authorized to accept these Terms on that entity’s behalf.

4. Accounts and Account Security

Some features may permit or require an account.

You agree to:

  • Provide accurate, current, and complete account information
  • Keep your information reasonably current
  • Protect your login credentials
  • Avoid sharing account access with unauthorized persons
  • Notify us promptly if you believe your account has been compromised

You are responsible for activity conducted through your account to the extent permitted by law.

We may suspend or terminate an account where we reasonably believe it has been used fraudulently, unlawfully, abusively, or in violation of these Terms.

5. Products and Product Information

Ashwood United may offer physical merchandise, digital products, or other items through the Services.

We attempt to describe products accurately. However:

  • Product colors may vary based on screens, lighting, production method, and materials.
  • Product dimensions and measurements may contain reasonable manufacturing tolerances.
  • Mockups may be illustrative and may not perfectly reproduce the final item.
  • Product availability may change without notice.
  • Some products are manufactured or printed only after an order is placed.
  • Designs, specifications, materials, packaging, and suppliers may change when reasonably necessary.

Product photographs, descriptions, size charts, and other information should be reviewed before ordering.

Nothing in this section limits any statutory right concerning goods that are materially defective, misdescribed, or otherwise nonconforming.

6. Pricing, Currency, and Taxes

Prices are displayed in the currency selected or made available through the storefront.

Prices may change at any time before an order is placed. A price change does not affect an order already accepted unless correction is permitted or required by applicable law.

Applicable taxes, shipping charges, customs charges, and other transaction costs will be displayed or calculated when available.

Fourthwall, as Merchant of Record, handles payment processing and collects and remits applicable sales tax and VAT for store transactions where required.

You are responsible for import duties, customs charges, brokerage charges, or similar amounts not collected during checkout unless applicable law provides otherwise.

7. Orders and Payment Authorization

Submitting an order constitutes an offer to purchase the identified products.

An automated acknowledgment does not necessarily mean that an order has been finally accepted. An order may be declined or canceled for reasons including:

  • Payment failure
  • Suspected fraud
  • Incorrect or incomplete customer information
  • Product unavailability
  • Pricing or listing errors
  • Shipping restrictions
  • Legal or regulatory restrictions
  • Violation of these Terms

If an order is canceled after payment has been collected, the applicable amount will be refunded through the original payment method, subject to processing times and applicable law.

You authorize Fourthwall and its payment providers to charge the payment method supplied at checkout for:

  • The product price
  • Shipping charges
  • Applicable taxes
  • Other amounts disclosed before purchase

Do not use a payment method unless you are authorized to use it.

8. Production, Shipping, and Delivery

Many physical products are made or printed after an order is submitted.

Production and delivery estimates are estimates rather than guarantees unless expressly identified as guaranteed.

Delivery may be affected by circumstances including:

  • Production volume
  • Carrier operations
  • Weather
  • Customs processing
  • Incorrect address information
  • Supply interruptions
  • Labor disruptions
  • Events outside the reasonable control of Ashwood United or Fourthwall

You are responsible for providing a complete and accurate shipping address.

If a shipment is delayed beyond an advertised or legally required timeframe, Ashwood United or Fourthwall will provide any notice, cancellation opportunity, or refund required by applicable law.

Risk of loss and legal title transfer as provided by applicable law and the fulfillment terms governing the transaction.

9. Order Changes and Cancellations

Because production may begin shortly after an order is placed, changes or cancellations cannot be guaranteed.

Contact shop support immediately when requesting an order change or cancellation.

An order may already be in production or fulfillment and therefore may no longer be eligible for modification or cancellation.

Any cancellation or refund remains subject to:

  • The current production status
  • Fourthwall’s fulfillment procedures
  • The Returns & FAQ Policy
  • Mandatory consumer law

10. Returns, Replacements, and Refunds

10.1 Made-to-order products

Most Fourthwall-fulfilled catalog products are produced after the customer places an order.

Except where mandatory law provides otherwise, Ashwood United does not accept returns, refunds, or exchanges for reasons such as:

  • Buyer’s remorse
  • A change of mind
  • Ordering the wrong size
  • Personal sizing preference
  • Color preference
  • No longer wanting the item
  • Failure to review the product description or size chart

10.2 Quality and fulfillment issues

A replacement or other appropriate remedy may be available for verified issues including:

  • An item arriving damaged
  • A material manufacturing defect
  • A defective or materially incorrect print
  • Receipt of the wrong product
  • Receipt of a size different from the size ordered
  • A materially incomplete shipment

Contact shop support promptly and within any period specified in the Returns & FAQ Policy.

You may be asked to provide:

  • The order number
  • A description of the issue
  • Clear photographs
  • Packaging information
  • Other information reasonably necessary to verify the claim

Fourthwall handles support and remedies for products fulfilled through its catalog.

10.3 Self-fulfilled products

Returns, refunds, replacements, and cancellations for products fulfilled directly by Ashwood United are governed by the product-specific terms and the Returns & FAQ Policy.

10.4 Digital products

Except where required by law, digital products are not returnable or refundable after they have been accessed, downloaded, delivered, or made available.

Where applicable law requires express consent before immediate delivery of digital content or acknowledgment that a cancellation right will be lost, that consent or acknowledgment may be requested during checkout.

10.5 Discretionary refunds

Ashwood United may approve a refund or other accommodation outside the published policy at its discretion.

A discretionary accommodation in one instance does not create an obligation to provide the same accommodation in another instance.

10.6 Mandatory consumer rights

Nothing in these Terms excludes or limits a warranty, cancellation right, legal guarantee, remedy, or other consumer right that cannot lawfully be waived.

Where the law governing a transaction provides greater protection than these Terms, the mandatory legal protection controls.

11. Promotions and Discount Codes

Promotions, discounts, free-shipping offers, giveaways, referral incentives, and discount codes may be subject to additional conditions.

Unless otherwise stated:

  • Promotions may not be combined.
  • Promotions have no cash value.
  • Promotions may be limited by product, location, customer, quantity, or time.
  • Discounts may not apply retroactively.
  • Ashwood United may correct or cancel a promotion affected by error, abuse, fraud, or technical malfunction.
  • Promotion terms may be changed before a qualifying order is submitted.

Any material terms will be presented with the applicable promotion.

12. Tools, Calculators, and Estimators

Ashwood United may provide free calculators, estimators, templates, guides, and similar informational resources.

These tools are provided for general informational and planning purposes only.

They are not:

  • Official tournament policies
  • Guaranteed predictions
  • Legal, financial, medical, tax, or professional advice
  • A substitute for publisher or tournament-organizer rules
  • A guarantee of qualification, placement, scheduling, revenue, cost, or performance

Tournament structures, Swiss rounds, standings, pairings, tiebreakers, draws, byes, drops, qualification thresholds, and other results vary by game, publisher, event tier, organizer, and actual player behavior.

You are responsible for verifying tool outputs against the official rules and requirements governing your situation.

Ashwood United does not guarantee that a calculator, estimator, or other tool will be accurate, complete, uninterrupted, or suitable for a particular purpose.

13. Event and Tournament Information

Ashwood United may publish information about tournaments, travel plans, appearances, scheduled events, or anticipated participation.

Unless explicitly stated otherwise:

  • Ashwood United does not own or operate third-party tournaments listed on the website.
  • Listing an event does not imply sponsorship, endorsement, authorization, or affiliation.
  • Planned participation may change.
  • Player attendance is not guaranteed.
  • Dates, venues, qualification requirements, registration availability, formats, and policies are controlled by the applicable organizer.
  • Visitors should confirm information through the official organizer before making travel or purchasing decisions.

Ashwood United is not responsible for losses arising from reliance on outdated or changed third-party event information, except where liability cannot legally be excluded.

14. Applications, Inquiries, and Proposals

The Services may allow you to submit:

  • Partnership inquiries
  • Sponsorship proposals
  • Employment applications
  • Contractor applications
  • Player or team applications
  • Media requests
  • Event invitations
  • Local game store proposals
  • Portfolios
  • Competitive histories
  • General inquiries

Submission of information does not:

  • Create an employment relationship
  • Create a contractor relationship
  • Create a player agreement
  • Create a partnership or sponsorship
  • Create an agency relationship
  • Guarantee an interview, proposal, response, or further consideration
  • Require Ashwood United to accept or pursue the submission
  • Create a confidentiality obligation unless the parties enter a separate written agreement

Do not submit:

  • Passwords
  • Payment-card information
  • Government identification numbers
  • Medical information
  • Confidential contracts
  • Trade secrets
  • Information you are not authorized to disclose
  • Malicious files or links

Ashwood United may accept, decline, archive, delete, or discontinue consideration of a submission, subject to applicable law and the Privacy Policy.

15. Employment and Competitive Opportunities

Job, contractor, player, analyst, creator, or other opportunity listings describe anticipated roles and requirements at the time of publication.

A listing does not constitute:

  • An employment contract
  • A guarantee that the position will be filled
  • A guarantee that the opportunity will remain open
  • A promise regarding compensation or classification beyond a final written agreement

Ashwood United may modify, pause, close, or cancel an opportunity before entering a binding written agreement.

Any final relationship is governed by its own written contract, offer letter, player agreement, contractor agreement, or other controlling document.

16. Third-Party Services

The Services may depend on or link to third-party providers, including:

  • Fourthwall
  • Elfsight
  • Salesforce
  • Google Workspace and Google Forms
  • Mailchimp
  • Google reCAPTCHA
  • Payment processors
  • Shipping carriers
  • Social-media platforms
  • Streaming and video platforms
  • Analytics providers
  • Tournament organizers
  • Event-registration platforms

Third-party services are governed by their own terms and privacy practices.

Ashwood United does not control and is not responsible for:

  • Their continued availability
  • Their independent data practices
  • Their content
  • Their security
  • Their service interruptions
  • Their pricing or policies
  • Transactions entered directly with them

A link or embed does not necessarily constitute endorsement.

17. Intellectual Property

The Services and all Ashwood United-created materials—including branding, written content, graphics, layouts, photographs, videos, designs, data compilations, and original merchandise artwork—are owned by or licensed to Ashwood United and are protected by applicable intellectual-property laws.

Subject to compliance with these Terms, Ashwood United grants you a limited, revocable, nonexclusive, nontransferable license to access the Services for personal, lawful use.

You may not, without prior written authorization:

  • Reproduce or commercially exploit Ashwood United content
  • Sell or redistribute website materials
  • Remove ownership notices
  • Create unauthorized derivative works
  • Use Ashwood United branding in a manner implying affiliation
  • Register domains, accounts, or businesses confusingly similar to Ashwood United
  • Use player photographs, profiles, or roster information for unauthorized commercial purposes
  • Train, populate, or operate a competing commercial database through systematic extraction of Ashwood United content

Limited quotation, commentary, news reporting, or other legally protected use remains subject to applicable law.

18. Third-Party Intellectual Property

Game titles, game artwork, publisher names, tournament names, logos, trademarks, and other third-party materials belong to their respective owners.

Their appearance on the Services does not imply that the owner:

  • Sponsors Ashwood United
  • Endorses Ashwood United
  • Has authorized a particular page or product
  • Is commercially affiliated with Ashwood United

unless the relationship is expressly stated.

Ashwood United intends to use third-party marks only as permitted by authorization, license, nominative use, commentary, reporting, or other applicable law.

19. User Submissions and Content

When you submit private information through an application or inquiry form, you grant Ashwood United a limited right to access, copy, store, evaluate, and share that material internally or with relevant service providers for the purpose for which it was submitted.

This limited right does not authorize Ashwood United to publicly publish your private application, resume, proposal, or confidential communication without additional permission or another lawful basis.

If you expressly submit content for public use—such as a testimonial, photograph, quote, article, competition result, or promotional contribution—any public-use rights will be governed by the accompanying permission, release, or agreement.

You represent that:

  • You have the right to submit the content.
  • The submission does not violate another person’s rights.
  • The submission is not unlawful, fraudulent, or malicious.
  • The information is materially accurate to the best of your knowledge.

20. Feedback

If you voluntarily provide suggestions or feedback concerning Ashwood United’s website, products, tools, operations, or services, you grant Ashwood United a worldwide, perpetual, irrevocable, nonexclusive, royalty-free right to use that feedback without compensation or attribution.

This section does not convert private applications, partnership proposals, resumes, or confidential business communications into unrestricted feedback.

21. Affiliates, Sponsorships, and Endorsements

Ashwood United may participate in:

  • Affiliate programs
  • Paid partnerships
  • Product-support arrangements
  • Sponsorships
  • Referral relationships
  • Compensated promotions

Ashwood United may receive money, products, discounts, services, commissions, travel support, or other benefits from these relationships.

Material relationships will be disclosed where required in connection with the relevant endorsement or promotional content.

Partner or affiliate status does not mean Ashwood United guarantees or warrants a third party’s product, service, conduct, or continued availability.

22. Prohibited Conduct

You may not use the Services to:

  • Violate any law or regulation
  • Infringe intellectual-property, privacy, publicity, or other rights
  • Impersonate Ashwood United, its players, personnel, or partners
  • Submit fraudulent applications, orders, inquiries, or proposals
  • Attempt unauthorized access to accounts, systems, or data
  • Circumvent security, anti-spam, rate-limit, or access controls
  • Introduce malware, malicious code, or harmful links
  • Interfere with the operation or availability of the Services
  • Conduct abusive or disruptive automated scraping
  • Collect personal information without authorization
  • Spam, harass, threaten, or deceive another person
  • Manipulate reviews, submissions, calculators, promotions, or transactions
  • Use the Services to facilitate fraud or unlawful commercial activity
  • Resell access to nonpublic Services without permission
  • Assist another person in any prohibited activity

We may investigate suspected violations and cooperate with lawful requests from regulators, courts, law enforcement, service providers, or affected parties.

23. Privacy

Our collection and use of personal information are described in the Ashwood United Privacy Policy.

By using the Services, you acknowledge that information may be processed by Ashwood United and applicable service providers as described in that policy.

Do not submit sensitive information unless specifically requested through an approved and appropriate channel.

24. Service Availability and Changes

Ashwood United may:

  • Modify the Services
  • Add or remove features
  • Correct errors
  • Change layouts or content
  • Restrict access
  • Suspend a feature
  • Discontinue a service

We are not obligated to maintain any particular feature indefinitely.

We will not retroactively deprive customers of rights arising from an accepted purchase except where permitted by law.

25. Suspension and Termination

Ashwood United may suspend or terminate access where reasonably necessary because of:

  • A violation of these Terms
  • Fraud or suspected fraud
  • Security threats
  • Abuse of the Services
  • Legal requirements
  • Risk to users, Ashwood United, Fourthwall, or another party

You may stop using the Services at any time.

Termination does not eliminate:

  • Payment obligations already incurred
  • Existing purchase rights
  • Accrued legal claims
  • Provisions that by their nature should survive termination

26. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

ASHWOOD UNITED DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

ASHWOOD UNITED DOES NOT WARRANT THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE
  • THE SERVICES WILL BE ERROR-FREE
  • INFORMATION WILL ALWAYS BE COMPLETE OR CURRENT
  • THIRD-PARTY SERVICES WILL REMAIN AVAILABLE
  • TOOLS OR CALCULATORS WILL PRODUCE ACTUAL RESULTS
  • EVENT INFORMATION WILL REMAIN UNCHANGED
  • USE OF THE SERVICES WILL PRODUCE A PARTICULAR COMMERCIAL, COMPETITIVE, OR PERSONAL OUTCOME

NOTHING IN THESE TERMS EXCLUDES ANY WARRANTY, LEGAL GUARANTEE, OR CONSUMER REMEDY THAT CANNOT LAWFULLY BE EXCLUDED.

27. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ASHWOOD UNITED AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR BUSINESS INTERRUPTION ARISING FROM THE SERVICES.

FOR A CLAIM ARISING FROM A PRODUCT PURCHASE, ASHWOOD UNITED’S AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

FOR ANY OTHER CLAIM, ASHWOOD UNITED’S AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID DIRECTLY TO ASHWOOD UNITED FOR THE RELEVANT SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM; OR
  • ONE HUNDRED U.S. DOLLARS

These limitations do not apply to the extent prohibited by law, including where applicable to:

  • Fraud
  • Willful misconduct
  • Gross negligence
  • Death or personal injury caused by legally actionable conduct
  • Mandatory consumer rights
  • Liability that cannot legally be limited

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, the provisions apply only to the maximum extent permitted.

28. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ashwood United and its officers, members, employees, contractors, and agents from third-party claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Services
  • Your material violation of these Terms
  • Your infringement of another party’s rights
  • Content you submit
  • Fraudulent, malicious, or deceptive conduct

Ashwood United may assume control of the defense of a matter subject to indemnification, and you agree to provide reasonable cooperation.

This section does not impose obligations that cannot lawfully be imposed on a consumer.

29. Governing Law and Disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise.

Any lawsuit arising from these Terms or the Services that may lawfully be brought exclusively in Washington must be brought in:

  • The appropriate state court located in Kitsap County, Washington; or
  • The United States District Court for the Western District of Washington

Nothing in this section prevents:

  • A party from bringing an eligible claim in small-claims court
  • A consumer from relying on mandatory rights available in the consumer’s jurisdiction
  • Either party from seeking urgent injunctive or equitable relief
  • The parties from attempting informal resolution before litigation

Before filing a formal claim, you are encouraged to contact Ashwood United and provide a reasonable opportunity to resolve the issue.

30. International Use

The Services may be accessed internationally, but availability does not mean every product, feature, opportunity, or service is lawful or available in every jurisdiction.

You are responsible for complying with laws applicable to your use of the Services.

Nothing in these Terms limits mandatory rights granted to consumers by the law of their country or region where those rights cannot be waived by contract.

If a provision conflicts with a mandatory local law, the provision will apply only to the extent legally permitted.

31. Electronic Communications

You consent to receive transactional communications electronically, including:

  • Order confirmations
  • Shipping information
  • Support communications
  • Account notices
  • Application confirmations
  • Partnership-inquiry confirmations
  • Updates to policies or Services

Marketing communications will be sent according to the Privacy Policy and applicable consent requirements.

Electronic records and agreements may have the same legal effect as paper records where permitted by law.

32. Changes to These Terms

Ashwood United may update these Terms prospectively to reflect:

  • Changes to the Services
  • Changes to business practices
  • Changes to third-party platforms
  • Legal or regulatory requirements
  • Security or operational needs

The “Last Updated” date will be revised when the Terms change.

Material changes may receive additional notice where reasonably appropriate or required by law.

The version in effect when an order is accepted will govern that order unless mandatory law requires otherwise.

Continued use of the Services after updated Terms become effective constitutes acceptance where legally permitted.

33. Assignment

You may not assign your rights or obligations under these Terms without Ashwood United’s prior written consent.

Ashwood United may assign these Terms in connection with:

  • A merger
  • Reorganization
  • Asset sale
  • Financing
  • Corporate restructuring
  • Transfer of the Services or business

Any assignment remains subject to applicable law and existing consumer rights.

34. Force Majeure

Ashwood United is not responsible for delay or failure caused by circumstances beyond its reasonable control, including:

  • Natural disasters
  • Severe weather
  • Fire
  • War
  • Civil unrest
  • Government action
  • Epidemics
  • Labor disputes
  • Carrier disruptions
  • Supplier failures
  • Utility interruptions
  • Internet or platform outages
  • Cyberattacks not caused by failure to use reasonable safeguards

This section does not remove any refund, cancellation, or other right required by law.

35. Severability

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

36. No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Ashwood United.

37. Entire Agreement

These Terms, the Privacy Policy, the Returns & FAQ Policy, product-specific disclosures, and any other expressly incorporated terms constitute the agreement governing use of the Services.

A separate signed agreement—such as an employment agreement, contractor agreement, player agreement, sponsorship agreement, or partnership agreement—controls over these Terms regarding the subject of that agreement.

38. Headings and Interpretation

Section headings are provided for convenience and do not control interpretation.

“Include” and “including” mean “including without limitation.”

Singular terms may include the plural and vice versa where context requires.
